Personal Injury
Represented a woman who suffered a concussion when the taxicab in which she was a passenger was struck by a bus that failed to stop for a red light. This matter resulted in a confidential settlement.
Represented a pedestrian who was struck by a bicycle courier, while crossing the street with the light and in a crosswalk. As a result of the collision, the client suffered a severely broken left arm, which required surgical repair. After we brought suit against the courier and the courier service by which he was “employed,” the courier service attempted to avoid liability by taking the position that they were not responsible for the courier’s conduct because he was an independent contractor rather than an employee. After obtaining a favorable ruling from the court on this issue, the matter was resolved with a favorable, confidential settlement.
Represented a woman whose car was rear-ended by a Metro bus. After determining that the bus’s brakes were faulty, the Metro bus driver was instructed to drive the bus (with the faulty brakes) back to the garage. While on route to the garage, the bus’s brakes failed and the bus collided with our client’s car, causing injury to our client. A favorable settlement was reached, the terms of which remain confidential.
Represented a gentleman who fell on a patch of ice in a parking lot, suffering a dislocated hip, which required surgical repair and painful physical therapy. This matter was resolved with a favorable, confidential settlement on the day of trial, shortly after the jury was sworn.
Represented a husband and wife who suffered severe soft-tissue, whiplash type injuries as the result of an automobile accident. Their car was struck from behind while they were stopped at a red light. A favorable, confidential settlement was reached on the day of trial.
Represented a woman who was involved in a serious accident when her car and a truck merged into the same lane. This matter was resolved to the client’s satisfaction after a complaint was drafted, and was tendered to the truck driver and his employer for their consideration, but without the need to file the complaint.
Represented an airline passenger whose tooth was shattered when he bit down on a small metal object hidden in a salad entree. The client required emergency dental treatment followed by the surgical removal of the tooth and the surgical implantation of a crown. This matter was resolved with a favorable settlement.
General Civil Litigation
Represented a gentleman who was sued pursuant to the terms of his “personal guaranty” of a contract entered into when he owned a business. After he sold the business, the company went bankrupt and the new owner defaulted on the contract. My client was sued, because he had “personally guaranteed” performance of the contract. This matter was resolved with a confidential settlement.
Represented a husband and wife after their front door was broken down, and their house searched by police. We asserted a claim for damages from a corporation on the theory that the corporation had negligently provided erroneous information to the police, resulting in the search. This matter was resolved with a confidential settlement.
Represented a gentleman who experienced problems with a used automobile shortly after its purchase. This matter was resolved with a settlement that involved the installation of a replacement engine by the used car dealer.
Represented a woman in connection with a claim brought by her landlord’s property insurance carrier alleging that she was responsible for damages that resulted from a fire in her apartment. This matter was resolved to the client’s complete satisfaction.
Civil Conspiracy and Negligence: Defended an employee of an assisted living facility in a civil action brought by the estate of a deceased resident of the facility. The action, in which our client was accused of civil conspiracy and negligence, and was sued for $350,000, was resolved following mediation with absolutely no admission of liability or financial contribution by our client.
Collection Action: Represented clients in a lawsuit seeking judgment for the amount of unpaid bills. This matter resulted in a favorable verdict following a bench trial.
Contract Dispute: Assisted in the representation of an interactive entertainment software developer in an action brought in the United States District Court for the District of Maryland involving allegations of tortious interference and unjust enrichment. This matter was resolved to the client’s satisfaction with a settlement, the terms of which remain confidential.
Contractor Dispute: Represented a homeowner in a dispute with a contractor regarding the installation of a defective, leaky skylight. This matter was settled to the homeowner’s satisfaction after a complaint was drafted and submitted to the contractor, without the need for the filing of the complaint.
Insurance Coverage Dispute: Represented excess insurance carriers in an insurance coverage dispute. This matter was resolved with a summary judgment ruling affirming the position that we promoted on behalf of the excess carriers.
Landlord Tenant Dispute: Represented a tenant in responding to allegations that he had breached his lease agreement. This matter was resolved in the tenant’s favor, and the tenant received a refund of his entire damage deposit.
Local Counsel: Have served as local counsel in a number of matters, including, most recently, a civil false claims qui tam action filed in the United States District Court for the District of Columbia.
Lost Luggage Claim: Represented a traveler whose bags were lost after he had entrusted them to Amtrak for safekeeping. Notwithstanding limitation of liability language printed on the reverse side of the claim check, we succeeded in obtaining payment in the full amount of our claim.
Public Health Service Physician Representation: Represented a number of physicians with regard to disputes with the Public Health Service concerning the terms of the physicians’ service obligations arising out of their participation in the National Health Service Corps Scholarship Program. In one instance it proved necessary to file a Declaratory Judgment Action. In every case a resolution fully satisfactory to the physician was achieved.
Employment Matters
Employment Discrimination: Represented a woman in an action alleging that her former employer had engaged in racial discrimination. This matter was resolved with a confidential settlement following mediation before a Federal Magistrate Judge.
Overtime Compensation: Represented a gentleman in asserting a claim for unpaid overtime over a three-year period. The claim was promptly resolved to the client’s complete satisfaction.
Retaliatory Discharge: Represented a woman in an action alleging that her former employer had terminated her employment in retaliation for her exercise of her rights exercised pursuant to the Family and Medical Leave Act. This matter was resolved with a confidential settlement following mediation with the DC Office of Human Rights.
Severance Agreements: Represented several individuals in the negotiation of the terms of the termination of their employment, including severance benefits.
Employment Contract Action: Filed and prosecuted a breach of employment contract action on behalf of a gentleman who was employed by a New Jersey based company to establish and develop a health maintenance organization designed to provide managed healthcare services in the District of Columbia, Maryland, and Virginia. Unfortunately, the lawsuit was stayed when the New Jersey based employer was placed into liquidation by the State of New Jersey.
Employment Contract Action: Assisted in the representation of an executive in an action brought against his former employer alleging breach of contract, unjust enrichment, and defamation. This matter was settled, to the client’s satisfaction, following a mediation session.
Employment Dispute: Represented a woman in connection with the denial of her claim for long term disability benefits. This matter was settled to the client’s satisfaction.
Employment Dispute: Twice assisted in the representation of a university professor in connection with disciplinary proceedings threatened by the university. On both occasions, the matters were resolved to the client’s satisfaction.
Medical Malpractice
Represented a gentleman who had to undergo a second surgery after suffering an infection caused by the failure of his oral surgeon to remove all of the bone shards during surgery to extract the gentleman’s wisdom teeth. This matter was resolved with a confidential settlement.
Represented a gentleman who underwent surgery for the removal of a cancerous tumor from his colon. We contended that the surgeon violated the requisite standards of care when he failed to heed the advice set forth in the report of the pre-surgical CT Scan regarding the possibility of a synchronous tumor in a second area, and that this area should be examined by a follow-up CT Scan and/or examined during the previously scheduled surgery for the removal of the cancerous tumor. We further contended that this violation of the standards of care caused the patient to have to undergo, among other things, follow-up surgery one year later (when the tumor was rediscovered), with corresponding physical and emotional pain and suffering, medical and out-of-pocket expenses, and lost income. This matter was resolved with a favorable settlement, the terms of which remain confidential.
Represented a gentleman in an action brought against his anesthesiologist and the hospital where he had undergone surgery. We alleged that the anesthesiologist and the hospital failed to satisfy the requisite standards of care in the rendering of proper post-operative care when the gentleman developed anesthesia related complications. We contended that this failure resulted in the development of further, severe, life threatening, complications necessitating a difficult and lengthy hospital stay. This matter was settled on favorable terms, which remain confidential.
Assisted in the representation of a young boy who was born with only one, deformed kidney which his pediatricians, and surgeon, failed to diagnose in spite of the fact that the boy was failing to develop normally but was, instead, “falling off of the growth charts,” and in spite of the fact that routine tests performed in advance of hernia surgery showed clearly abnormal results. We contended that these failures denied the boy the possibility of timely kidney surgery, and subjected the boy to the need for long-term renal dialysis and the likelihood of an eventual kidney transplant. This matter was resolved on the eve of trial with a favorable settlement, the terms of which remain subject to a confidentiality agreement.
